Heard learned Counsel Mr. S.K.Goswami for the petitioner Chinmay Kumar Das who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 18.06.2025 in connection with All Women PS Case No. 55/2025 under Section 69 of the BNS,2023. Page No.# 2/3 2. Mr. B.Sharma, learned Addl.Public Prosecutor appearing for the State has submitted that investigation is at its nascent stage. The offence is of a heinous nature. There are incriminating materials in the Case Diary. Investigation may be adversely affected if the petitioner is released on bail. 3. I have considered the submissions at the Bar with circumspection. 4. The FIR dated 16.06.2025 unfolds that the victim got acquainted with the petitioner from 27.05.2021. The petitioner has been maintaining love relationship with the victim and thereafter the petitioner induced the victim to have physical relation with him with false promises of marriage. Continuously, from the year 2021, the petitioner has been promising the victim that he would marry her. The victim trusted the petitioner and she had a love relationship with the petitioner and all the neighbours believed that they were a married couple. Finally, the victim came to know on 13.06.2025 that the petitioner got married to another woman, a month prior to 13.06.2025. 5. It is submitted on behalf of the petitioner that the victim has brought up a false case against the petitioner as soon she learnt that the victim got married to another woman. An ejahar has been lodged against the petitioner and GD entry was made. 6. I have scrutinized the Case Diary. There are indeed incriminating materials in the Case dairy against the petitioner. The victim has implicated the petitioner in her statement under Section 161 CrPC. Investigation has progressed substantially. The petitioner is willing to co-operate with the remaining part of investigation. 7. It appears that bail may be granted to the petitioner. Page No.# 3/3 8. The petitioner named above shall be released on bail on furnishing a bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup(M), Guwahati subject to the following conditions: i) That the petitioner shall not exercise any threats or try to influence witnesses. 9. On breach of any of the above conditions, learned court is at liberty to immediately cancel the bail granted to the petitioner. 10.
