Accused no.5 in C.C.No.8057/2024 pending before the Court of III Addl. Civil Judge & JMFC, Anekal, arising out of Crime No.196/2024 registered by Jigani Police Station, Bengaluru District, for the offences punishable under Sections 420, 468, 47 IPC and Sections 12(1)(B), 12(1A)(a)(b) & 12(2) of Passports Act, 1967, is before this Court under Section 439 Cr.PC seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.196/2024 was registered by Jigani Police Station, Bengaluru District, against Rashidh Ali Siddakki @ Shankar Sharma and others based on the first information dated 29.09.2024 received from Manjunatha.B.S., Police Inspector attached to Jigani Police Station, Bengaluru District. During the course of investigation, petitioner herein who was arrayed as accused no.5 in the FIR was arrested on 05.10.2024 and subsequently remanded to judicial custody. Investigation of - 3 - NC: 2025:KHC:15753 CRL.P No. 972 of 2025 the case is completed and charge sheet is now filed against 11 accused persons and one other juvenile accused. Bail application filed by the petitioner before the jurisdictional Sessions Court in Crl. Misc. No.5548/2024 was rejected on 30.12.2024. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that based on the credible information received by the first informant, he had conducted a raid to property bearing No.87, Anagha Layout, Near DLF, Rajapura village, within the jurisdiction of Jigani Police Station, Bengaluru District, and on verification found that the persons who are residing in the house were Pakistan Nationals, who had changed their names and lived in the vicinity impersonating themselves as Hindus. The said persons were apprehended and during the course of interrogation, they had revealed that they had illegally entered into India through Bangladesh, and thereafter, with the help of the petitioner, they had created fraudulent passports, Aadhaar cards, PAN Cards, etc., and were living in India from the year 2018 onwards. Based on their statements, petitioner was arrested. - 4 - NC: 2025:KHC:15753 CRL.P No. 972 of 2025 5. Charge sheet allegations would go to show that accused nos.1 to 4 are Pakistan Nationals and are members of a religious outfit known as Mehadi foundation and they had illegally entered India and after contacting petitioner, who is a follower of Mehadi foundation, with his help had managed to create fraudulent passports, aadhaar cards and PAN Cards, voter identity cards, etc., and had changed their muslim names into Hindu names and were living in a rented premises within the jurisdiction of Jigani Police Station and had continued their activities of religious preaching. 6. Material on record would go to show that the petitioner is arrayed as an accused in a similar case registered by the very same police station in Crime No.210/2024. Petitioner has indulged in anti-national activities and considering the gravity of allegations against the petitioner who is a person with criminal antecedents, merely for the reason that investigation of the case is completed and charge sheet is filed, he cannot be enlarged on bail. The material on record would also go to show that petitioner does not have a permanent address and in the event he is enlarged on bail, it would be difficult to secure his presence. Under the circumstances, I am of the opinion that it - 5 - NC: 2025:KHC:15753 CRL.P No. 972 of 2025 is not a fit case to grant regular bail to the petitioner. Accordingly, petition is dismissed.
