Neutral Citation No. - 2025:AHC-LKO:37853-DB Court No. - 2 Case :- WRIT - C No. - 6311 of 2025 Petitioner :- Pramod Kumar Singh Respondent :- Indian Oil Corporation Limited And 2 Others Counsel for Petitioner :- Bhoopal Singh Counsel for Respondent :- Kumar Ayush Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. By means of this writ petition the petitioner has prayed for issuance of a writ, order or direction in the nature of Certiorari thereby quashing the order dated 16.04.2025, issued by the opposite party no.2 i.e. Divisional Head, Indian Oil Corporation Limited, Vibhuti Khand, Gomti Nagar, Lucknow (after summoning from him), thereby illegally and arbitrarily cancelling the petitioner's candidature for award of RO dealership between KM stone 220 and 231 On LHS of Old SH1A (now NH330B), while going from Gonda to Lucknow District Gonda, State Uttar Pradesh under open category advertised on 11.08.2023. He has further for issuance of a writ,
order or direction in the nature of mandamus thereby commanding and directing the opposite parties no.2 and 3 to award the RO dealership between KM stone 220 and 231 On LHS of Old SH1A (now NH330B), while going from Gonda to Lucknow District Gonda, State Uttar Pradesh. We have gone through the impugned order dated 16.04.2025 which contains reasons for not issuing a letter of intent to the petitioner in spite of his selection for allotment of Retail Outlet. One of the reasons is that apart from the petitioner, two other persons have applied offering the same Gata No. 169, which is impermissible as per guidelines of selection of dealers for regular and rural retail outlets through draw of lots/bidding process, specifically Note 1(c) to 4(p) of the aforesaid guidelines. Second reason is the report of the D.M. Colonel Ganj relating to Gata No. 169, according to which frontage of offered land is less than 70 meters along the road which is less than the minimum requirement for application of two candidates in same Gata. As two plots having frontage of 35 meters each cannot be carved out from the offered plot your candidature is found ineligible, therefore, candidature of the petitioner has been rejected. The petitioner's counsel has not been able to satisfy the court
regarding any illegality in the above. If he is able to satisfy the opposite parties in this regard, it shall be open for the petitioner to move an application within one week from today, which can be considered by the concerned opposite party as per law. With these observations/direction, this writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
