JUSTICE RAJNESH OSWAL, JUDGE O R D E R 09.10.2025 In response to our order dated September 15, 2025, a compliance report by way of affidavit has been filed on behalf of the respondents, appended therewith is a copy of the order dated October 8, 2025, vide which the Administrative Secretary, Jal Shakti Department, has been assigned the charge of Chairman, J&K Water Resources Regulatory Authority (J&KWRRA), till the conclusion of selection process. Similarly, the required affidavit indicating the precise schedule within which the entire process of selection is to be concluded has also been submitted: “4. That the re-advertisement and subsequent selection shall be undertaken under the relevant section of the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010 and Rules, in order to have a suitable person to occupy the vacant position of Chairperson and Member, these vacant positions may be filed in the following manner and time as indicated below:- i. The notice for re-advertisement of the posts shall be undertaken within a period of ten (10) days and will be published through print media/ electronic media. ii. The time frame prescribed for receipt of applications/ resumes in Jal Shakti Department will be provided as twenty one (21) days. iii. That in case the number of applications received are lesser than desired, ten (10) days extension may be provided for the cut-off date for submission of applications. iv. That scrutiny of applications and preparation of a panel of eligible candidates shall be completed within ten (10) days and accordingly will be placed before the Selection Committee for consideration and finalization in terms of Section 141 of the J&K WARRA Act 2010.” In the wake of the above facts, learned senior counsel for the petitioner submits that, for the present, nothing survives in the writ petition and the same be disposed of as having been rendered infructuous. However, in the event any fresh cause of action arises in future, the petitioner be granted liberty to file a fresh petition as regards his grievances and concerns.
