The petitioner claims that after the death of his father Chandra Shekhar Gargya, who was Head Master, Government Primary School Budoli, District Rudraprayag, he had applied for appointment under the Dying and Harness Rules. He is qualified, but his application has not been decided by the respondents. The petitioner claims that the respondents may be directed to decide the application of the petitioner for appointment on compassionate ground and appoint the petitioner accordingly. Heard learned counsel for the parties and perused the record. Learned counsel for the petitioner submits that after the death of father on 27.05.2016, the petitioner has been approaching the respondents to consider his appointment on compassionate ground, but his application, which is Annexure 8 to the petition has yet not been decided. Learned State counsel submits that the application that has been filed by the petitioner which is Annexure 8 to the petition shall be decided within eight weeks from today. The Court takes on record the statement given by the learned State counsel. The writ petition is disposed with the direction to the respondents to decide the application of the petitioner, Annexure 8 to the petition within eight weeks from today in accordance with law.
