Order No.08 Dated- 20-02-2025
No one turns up on behalf of either of the parties. Apprehending their arrest in connection with Rajmahal P.S. Case No.235 of 2022 instituted under Sections 306/34 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail. It has been averred in the instant anticipatory bail application that the allegation against the petitioners is that the petitioners, in furtherance of their common intention, abetted the commission of suicide of the daughter of the informant namely Pinki Das. It is further averred that the allegation against the petitioners is false. It is further averred that the petitioner Nos.1 and 2 are farmers and the petitioner No.3 is the Mukhiya of the Panchayat. Admittedly, the deceased was in distress because of commission of suicide by her husband because of dowry demand made by her father-in-law and mother-in-law namely Krishna Mahaldar and his wife. It is next averred that the petitioner No.3 instituted Radhanagar P.S. Case No.179 of 2022 and as a counter-blast, this false case has been foisted against the petitioners and there is no overt act attributed to the petitioners, which could have led the
deceased to commit suicide. It is also averred that the petitioners are ready and willing to abide by any terms and conditions imposed upon them by this Court. Considering the facts and circumstances of the case, I am inclined to grant privileges of anticipatory bail to the petitioners.
Accordingly, the petitioners are directed to surrender in the Court below within six weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on depositing Rs.10,000/- each as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rajmahal in connection with Rajmahal P.S. Case No.235 of 2022 with the condition that they will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish their mobile number and photocopy of the Aadhar Card with an undertaking that they will not change their mobile number during the pendency of the case and they will not annoy or disturb the informant in any manner during the pendency of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
