CORAM:
HON’BLE MR. JUSTICE MOHD YOUSUF WANI, JUDGE
ORDER 15.10.2025
1. Heard.
2. The case of the petitioner in nutshell is that he is a duly registered Government contractor under registration No. 196/A/CE/KCC/PDC/1995-96 with a proven record of successful departmental works. That he was allotted the contract for construction of a Double Storeyed New Type Primary Health Centre at Warpora Sopore. That he executed substantial work up to the ground floor slab strictly as per the approved specifications, which were duly measured, verified and certified by the Assistant Executive Engineer and Executive Engineer, confirming its quality and conformity with departmental standards. That on such verification, he became entitled to a certified payment of Rs. 36.38 lacs. That the liability stands admitted in official communications of the Executive Engineer dated 29.01.2025 and the Superintending Engineer dated 19.08.2025, but payment has been withheld solely for want of funds. That a revised estimate of Rs. 202.33 lacs, incorporating his dues, further reinforces this acknowledgment. That despite repeated representations, the respondents have neither released the certified
amount nor settled his claim and are now proceeding to re-tender the same work without terminating the existing contract of clearing his dues.
3. Heard the learned counsel for the petitioner and considered his
submissions.
4. In the facts and circumstance of the case, this Court is of the opinion that matter can be disposed of at this stage by passing of appropriate orders which are not likely to prejudice the interests of the other party.
5. Accordingly, the instant matter is disposed of with the direction to the respondents to take immediate steps for releasing the amount of admitted liability, in favour of the petitioner within a period of 8 weeks. The respondents are also directed to consider under law the execution of the balance work out of the contract already allotted to the petitioner vide No. 15862-66 dated 01.02.2019 issued by the respondent No. 4, i.e., Executive Engineer, R&B Division Sopore, by him, with the submission of a report of compliance to this Court.
