The instant application has been filed with the prayer for direction to the Judicial Magistrate-III, Lucknow to expedite the Case No. 156 of 2010 (State Vs. Dr. Vishwa Prakash Arya and others), arising out of Case Crime No. 513 of 2009, under Sections 498-A, 323, 504 IPC and Section 3/4 of D.P. Act, Police Station Alambagh, District Lucknow. Learned counsel appearing for the applicants submits that the matter pertains to the year 2009, but even after passing of sixteen years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicants submits that interest of justice would be sub- surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the Judicial Magistrate-III, Lucknow is directed to decide the Case No. 156 of 2010 (State Vs. Dr. Vishwa Prakash Arya and others), arising out of Case Crime No. 513 of 2009, under Sections 498-A, 323, 504 IPC and Section 3/4 of D.P. Act, Police Station Alambagh, District Lucknow, with expedition, in accordance with law, considering the instructions and guidelines issued by this court; time to time.
