Upon coming of the instant petition for consideration, the learned counsel for the petitioner would candidly submit that the amount of arrears of maintenance being Rs. 84000/- payable to the respondents herein by the petitioner herein has been fixed by the Trail court at Rs 24000/- per month and that the petitioner on account of his poor economic conditions will be able to pay the said arrears in 10 instalments to the respondent herein instead of eight instalments. 2. The prayer of the petitioner seems to be bonafide having regard to the case set up in the petition. 3. Accordingly, without commenting upon the merits of the case and in the interest of justice the instant petition is disposed of by providing that the petitioner herien shall pay the arrears of maintenance of Rs, 84000/- to the respondents herein in 10 monthly equal instalments instead of 8 monthly instalments as directed by the Trail court. 4. The order of the Trail court accordingly in this view of the matter shall stand modified and petition shall stand disposed of. 5. However, it is made clear that in the event the petitioner makes any default in payment of the aforesaid monthly instalment of maintenance to the respondents herein at any point of time, the present order shall be deemed to have been recalled and the trail court shall be free to proceed against the petitioner in the matter in accordance with law. 6.
