JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Pratiush Lala, Advocate For the State : Mr. Jitendra Pandey, A.P.P. ----- Order No.02 Date: 27th May, 2025 The petitioner is an accused for the offence punishable under Sections 191(2), 191(3), 190, 324(5), 326 of Bharatiya Nyaya Sanhita (B.N.S.). 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. Even on perusal of the self-statement of the informant (Circle Inspection of Mahuda Circle Office), it would be evident that 60 persons have been implicated in this case on the basis of hearsay statements of the villagers. The name of the petitioner has been mentioned at Serial No. 56 in the said self-statement. Except that there is no cogent and reliable evidence to connect the petitioner with the alleged offence. He is in judicial custody since 04.02.2025. At least, considering the length of judicial custody, the petitioner may be given the privilege of regular bail. 3. Learned A.P.P. has opposed the petitioner’s prayer for regular bail. 4. Having heard the learned counsel for the parties, considering the materials available on record as well as keeping in view that the petitioner is in judicial custody since 04.02.2025, I am inclined to enlarge him on bail. 2025:JHHC:14250 Page | 2 5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Madhuban P.S. Case No. 03 of 2025, subject to the condition that the petitioner shall co-operate in the trial and shall present as and when required by the learned Trial Court, failing which the said court is at liberty to cancel the bail bond of the petitioner.
