By means of this writ petition the petitioner has prayed for issuance of a writ order or direction in the nature of MANDAMUS commanding to opposite parties to ensure to grant permission for installing the Tazia (Tomb of Immam Hussain) at the residence of the petitioner which is schedule to be held on 06/07/2025 in pursuance of the application moved by him contained as Annexure no. 1 & 2 to the writ petition. He further prays for issuance of a writ order or direction in the nature of MANDAMUS commanding to opposite parties to not create any hindrance in peaceful installing the Tazia at his residence which was being installed each and every year. An application of the petitioner, contained as Annexure No. 1 and 2, seeking permission to keep on/immerse Tazia is said to be pending before the Sub Divisional Magistrate, Nanpara District Bahraich. As stated by the counsel for the State, the Police have already submitted their report to the S.D.M. Let the S.D.M. concerned take a decision on the aforesaid application, contained as Annexure No. 1 and 2, within 24 hours and communicate the same to the petitioner within the same period. With the above observations/directions, this writ petition is disposed of. Office is directed to issue certified copy of this order today itself, on payment of usual charges.
