1. Mr. Mukesh Singh Rawat, learned counsel for the applicant.
2. Mr. Shobhit Saharia, learned counsel for the respondent-NCB.

Present applicant Pushpendra Singh alias Praveen Chauhan, S/o Karan Singh is praying for bail in reference to Criminal Case No. 06 of 2025, Police Station NCB Dehradun, wherein the present applicant along with one Chandan Singh Bhandari have been implicated for the offences punishable under Sections 8/20 read with Section 29 of Narcotic Drugs and Psychotropic Substances Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore there is no substantial compliance of mandatory provisions of the N.D.P.S. Act. Apart from this, he also submits that the applicant has two previous cases of similar nature, however in both the cases, he is bailed out. He further submits that the alleged contraband Charas which is shown to be recovered is a joint recovery from both the persons and is non commercial quantity i.e. 605 gram.
5. The NCB file the counter affidavit and stated therein that all the mandatory provisions of N.D.P.S. Act has been complied with. Yesterday, the counsel for the NCB was asked to get the inventory report as well as the certification which is mandatory requirement in view of Section 52 of the N.D.P.S. Act.

Learned counsel for the NCB placed before this Court the inventory as well as the certification and on perusal of the inventory as well as the certification, this
2025:UHC:10311 Court is of the view that there is full compliance of Section 52-A of the N.D.P.S. Act. Apart from this, Mr. Shobhit Saharia also apprise to this Court that the investigation is still going on.

Be that as it may, admittedly, the contraband (Charas) which is shown to be recovered is a non commercial quantity and the applicant is languishing in jail since 25.09.2025 and in two other cases of similar nature, the applicant is already bailed out, this Court is of the view the applicant deserves for bail. Simultaneously keeping in view the past conduct of the applicant some stringent condition is also being imposed upon him.
8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
9. Let the applicant “Pushpendra Singh alias Praveen Chauhan” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
10. It is made clear that after being released on bail, the applicant shall report to the concerned nearest Police Station on the first day of every month and shall provide his mobile number, failing which, the officers of NCB is free to apprise this Court by moving an application for cancellation of bail and the applicant shall also cooperate with the pending investigation.
