[2025:RJ-JP:17997] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 5557/2025 Om Prakash Yadav S/o Shri Lallu Ram Yadav, Aged About 56 Years, R/o Plot No. 28, Behind Khandela House, Hazi Colony, Jhotwara Road, Jaipur, Rajasthan. Presently Working In The Office Of AEN, Public Health Engineering Department, City Sub-Division-Vi (North-I), Banipark, Jaipur, Rajasthan. ----Petitioner Versus 1. State Of Rajasthan, Through Its Principal Secretary, Public Health Engineering Department, Rajasthan, Secretariat, Jaipur. 2. The Chief Engineer (Administration), Public Health Engineering Department, P.H.E.D. Head Office Campus, Rajasthan, Jaipur. 3. Assistant Engineer, Public Health Engineering Department, City Sub-Division-VI (North-I), Banipark, Jaipur, Rajasthan. ----Respondents For Petitioner(s) : Mr. C. P. Sharma For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL Order 29/04/2025 1. Petitioner has invoked the writ jurisdiction of High Court under Article 226 of Constitution of India, impugning the order dated 25.02.2025, whereby and whereunder the Screening Committee of Public Health Engineering Department, after appreciation of the record, has declared the petitioner ineligible for grant of Semi-permanent status to the post of ‘Store Munshi’. [2025:RJ-JP:17997] (2 of 2) [CW-5557/2025] 2. Counsel for the petitioner submits that as a matter of fact, petitioner though has been regularized on the post of ‘Helper’ but he was indeed discharging duties as “Store Munshi’ and his denial to grant status of Semi-permanent by the Screening Committee is against the record and perverse. 3. Indisputably, to appreciate the claim of grant of status as Semi-permanent to the petitioner on the post of ‘Store Munshi’, requires appreciation of evidence on record, more so when the fact finding recorded by the Screening Committee in the order dated 25.02.2025, go against the petitioner. 4. In view of above, counsel for the petitioner prays to relegate the petitioner to approach directly before the Labour Court, raising a claim for regularization and consequential benefits against the respondents without moving any application in this respect before the Conciliation Officer. 5. As a result, without entering into merits of the writ petition, instant writ petition is disposed of, relegating the petitioner to approach before the Labour Court, for ventilating his grievance, as raised herein, as also to assail the order impugned dated 25.02.2025. 6. Stay application and any other pending application, if any, also stand disposed of. (SUDESH BANSAL),J TN/6
