Neutral Citation No. - 2025:AHC-LKO:40493-DB Court No. - 2 Case :- WRIT - C No. - 6408 of 2025 Petitioner :- Chhoti Devi Alias Chhoti Bitiya And 2 Others Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 5 Others Counsel for Petitioner :- Mohammad Saqib Siddiqui,Bajhul Quamar Siddiqui Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioners appear to have entered into an agreement with the opposite party Nos.5 and 6 for excavation/digging of soil from their bhumidhari land, however, contrary to the agreement the soil is being dug up in excess of what was agreed upon. Some application has been filed before the District Magistrate and an inquiry was got conducted, wherein as claimed by the petitioners' counsel, the allegations were found to be correct, however, on being asked as to under which provision of law the District Magistrate has proceeded to get an inquiry conducted, learned counsel for the petitioners fairly submitted that there is no such provision of law. We are afraid, the dispute is a private one between private parties and we see no reason to interfere in such dispute as there are other remedies prescribed for the said purpose, which can be availed by the petitioners. Writ Petition stands disposed of. (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 16.7.2025 Saurabh Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
