Heard the parties. The petitioner has moved this Court for grant of bail in connection with S.T. Case No.155 of 2025 arising out of Sukhdeonagar P.S. Case No.463 of 2023 registered for the offences punishable under sections 302, 201 read with 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed murder of her husband. It is further submitted that the allegations against the petitioner are all false. It is next submitted that as per the independent witness- who is the landlord of the house, where the petitioner and her husband were residing, there was no one except the petitioner and the victim, in the tenanted premises where the deceased and the petitioner were residing and their relationship was cordial. It is next submitted that the deceased before his death was taken to two hospitals. It is next submitted that the undisputed
facts remains that the deceased met with an accident while riding a motorcycle and the said accident, he sustained severe injury and starting from his left waist to the top of his body, there are paralytic attack and the petitioner took him to Coimbatore for specialized treatment. It is next submitted that, no motive has been attributed to the petitioner as to why she
will kill her own husband. It is next submitted that charge sheet has already been submitted in this case. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para-12 of this bail application. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertake that they will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 29.11.2024 as is evident from para-07 of this bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-XI, Ranchi, in connection with S.T. Case No.155 of 2025 arising out of Sukhdeonagar P.S.
