After response of the petitioner to the show cause notice dated 14.05.2024, considering the same, proceedings for eviction were initiated under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971 by the Lucknow Nagar Nigam. Therefore, the impugned notice has become infructuous. Now, the matter is to be considered in the proceedings under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971. We, accordingly, quash the impugned notice in view of the admitted factual position which has been fairly accepted by Shri Siddharth Shankar Dubey, learned Counsel for the opposite parties no. 1 and 2. The writ petition is accordingly disposed of.
