Neutral Citation No. - 2025:AHC-LKO:46831 Court No. - 12 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 1408 of 2022 Applicant :- Adarsh Singh Opposite Party :- State Of U.P. Thur. Prin. Secy. Home Lko. Counsel for Applicant :- Amit Singh,Raj Kumar Singh Counsel for Opposite Party :- G.A.,Dheerendra Kr. Agnihotri Hon'ble Karunesh Singh Pawar,J. Heard learned counsel the applicant and learned A.G.A. for the State. The present application under Section 438 Cr.P.C./482 B.N.S.S. has been filed by the applicant- Adarsh Singh seeking anticipatory bail in FIR/Case Crime No. 218 of 2021, under Sections 366, 376, 323, 504, 506 I.P.C. & 3/4 Dowry Prohibition Act, 1961, P.S. - Bihar, District - Unnao. This is the second anticipatory bail application. The first anticipatory bail application was disposed of by a coordinate bench of this Court vide order dated 5.8.2022 passed in Criminal Misc. Anticipatory Bail Application No. 950 of 2022. Perused the record. A perusal of the aforesaid order shows that an alternative prayer was made by the applicant for filing regular bail. But instead of filing regular bail, he has filed this second anticipatory bail application. Considering the order dated 5.8.2022 passed in the first anticipatory bail application, whereby the applicant was granted liberty to move a regular bail application and he was directed to surrender before the concerned court within one month from 5.8.2022 and till date, he has not complied that order as well as considering the gravity of the offence and the earlier conduct of the applicant, I am not inclined to enlarge the applicant on anticipatory bail. In view of the above, the anticipatory bail application is rejected. Order Date :- 11.8.2025 Shravan Digitally signed by :- SHRAVAN KUMAR High Court of Judicature at Allahabad, Lucknow Bench
