Heard learned counsel for the petitioner, learned State Counsel appearing on behalf opposite parties 1 to 6 and Dr. Udai Veer Singh, learned counsel for opposite party no.7. 2. Present petition under Article 226 of Constitution of India has been filed seeking a direction to authority concerned for release of post-retiral dues of petitioner in view of fact that petitioner has superannuated from service on 31.01.2025. 3. Learned State Counsel on the basis of instructions, however, submits that retiral dues of petitioner are still pending owing to fact that petitioner has been found guilty of causing pecuniary loss to department in the departmental proceedings. 4. Learned counsel for petitioner on the basis of instructions, however, submits that he is not aware of any enquiry having taken place in which petitioner has participated. 5. Considering factual dispute raised by learned counsel for the parties, liberty is granted to petitioner to file fresh representation before opposite party no.4 i.e. District Inspector of Schools, Barabanki or any competent authority, who shall consider and decide the same within a period of four weeks from the date of receipt of fresh representation along with a certified copy of this order. In case petitioner is found entitled for the said benefits, actual payment thereof, shall be ensured within a period of six weeks thereafter. 6. With aforesaid direction, the petition stands finally disposed of.
