GUNESHWAR SHARMA Order 28.04.2025 [1] Heard Mr. Ajoy Pebam, learned counsel for the petitioner and Mrs. Ch. Sundari, learned G.A. for the State respondent. [2] The petitioner approached this Court by way of the present writ petition, inter-alia, praying for releasing a sum of Rs. 35,32,500/- only for supply order No.EE/WSPCD/PHED/SO/403/2022- 23/14 dated 05.01.2023 issued by the Executive Engineer, Water Supply Project Constn. Division PHE Department, Manipur at the earliest. In this regard, the petitioner has also served legal notice on 13.05.2024 to the Commissioner/Secretary (PHED), Government of Manipur for releasing the said amount. [3] During the course of hearing, Mr. Ajoy Pebam, learned counsel for the petitioner, submits that he has been instructed to withdraw the writ petition with liberty to approach the authority by submitting a fresh representation with respect to the prayer made in the writ petition. [4] Mrs. Ch. Sundari, learned G.A., submits that this Court may pass appropriate order in terms of the alternative prayer made by the learned counsel for the petitioner. [5] Recording the submissions made at the bar, writ petition is dismissed as withdrawn with liberty to approach the respondents again with a prayer for releasing a sum of Rs. 35,32,500/- only. The representation may be submitted within a period of one week from the date of receipt of a copy of this order and the respondents are directed to consider and pass a speaking order to the proposed representation to be submitted by the petitioner within a period of two months from the date of submission of the representation.
