05/ 22.07.2025: Heard, learned counsel for the parties.
2. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending their arrest for the offences under Sections 41 and 42 of the Indian Forest Act, in connection with C. Case No.1435 of 2024, pending in the Court of learned S.D.J.M., Koderma.
3. It is alleged that these petitioners and others were running a saw mill illegally in the forest area without any valid license.
4.
Learned counsel representing the petitioners submits that from the seizure list, it would be clear that only a wheel of the machine was seized. He further submits that there is no criminal antecedent of the petitioners.
5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
6. Considering the submission of the petitioners and considering the seizure list, I direct the petitioners to appear before the concerned Court. Once the petitioners appear, their bail bonds will be accepted subject to furnishing of sureties to the satisfaction of the concerned Court. The petitioners should file an additional undertaking that they will appear
before the Trial Court as and when required during trial and will not take unnecessary adjournments.
7. With the aforesaid observations, this Anticipatory Bail Application stands disposed of.
