JUSTICE PARTHIVJYOTI SAIKIA ORDER 20.08.2025 Heard Mr. F Z Mazumder, learned counsel for the petitioner. Also heard Mr. K K Das, learned Additional Public Prosecutor, Assam. This is the 2nd bail application filed under Section 482 of the BNSS, 2023 by the petitioner praying for release him in pre-arrest bail, who apprehends arrest in connection with Badarpur P.S. Case No. 48/2025. The earlier bail application was rejected by this court on the ground that the case involves a financial scam for which a thorough investigation is necessary. Today also, no new ground has been pleaded. This court is of the opinion that in such offences custodial interrogation must be necessary. Therefore, this court holds that this is not a fit case for granting privilege of anticipatory bail under Section 482 of the BNSS.
