The present petition has been filed with the following prayer : "(i). Issue a writ order or direction in the nature of mandamus commanding the Opp. Party no. 2 & 4 to remove the illegal encroachment over the 'Khalihan' pertaining to gata No. 18 area 0.1210 hectare situated at revenue Village- Rasuli Chak, H/o- Begampur, Police Station-Ramgaon, Pargana, Tehsil & District- Baharaich which was encroached by the Opp. party no. 6 to 9 forthwith, in the interest of justice. (ii). issue a writ order or direction in the nature of mandamus commanding the opposite parties to remove their illegal encroachment over the 'Khalihan' pertaining to gata No. 18 area 0.1210 hectare situated at revenue Village- Rasuli Chak, H/o- Begampur, Police Station- Ramgaon, Pargana, Tehsil & District- Baharaich and, further the stern action may also be taken against the guilty persons, in the interest of justice." 3. Standing Counsel based upon the instructions states that the proceedings under section 67 of the UP Revenue Code have already been initiated. 4. In view thereof, the present petition is disposed off with direction to the respondent no.4 to conclude the proceedings within a period of ninety days in accordance with law.
