HON'BLE PRASHANT KUMAR, J.
1. Heard learned counsel for the parties.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the impugned order dated 05.11.2028 passed by the District Magistrate, Kheri and impugned orders dated 31.12.2017 and 28.03.2018 passed by the Oriental Insurance Company rejecting the claim of the petitioner for the benefit under the 'Mukhyamantri Kisan and Sarvhit Bima Yojana' (hereinafter referred to as the 'Scheme').
3. The reason given for rejecting the said claim is that the deceased was not the head of the family/bread earner. Similar reason has been provided in the order dated 28.03.2028 passed by the Oriental Insurance Company.
4. Upon perusal of the documents and after hearing learned counsel for the parties, we are of the view that the reasons given for rejecting the application of the petitioner are extraneous in nature and do not comply the terms and conditions of eligibility as per the Scheme.
