PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A1, seeking regular bail, in Crime No.50 of 2023 of Yelapaka Police Station, Alluri Sitharama Raju District, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution is that, on 27.04.2023, the Sub- Inspector of Police Station along with his staff and mediators rushed to outskirts of purushothapatnam village, yatapaka mandal and caught A3 to A6 in possession of 150 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 2 3. Heard. Perused the record. 4. Learned counsel for the petitioner submits that basing on the confessional statement of co-accused, the petitioner herein/A1 is arrayed as accused in the present crime. In pursuant to the confessional statement, the petitioner herein was arrested on 19.1.2025 and since then he has been in judicial custody. Except the confessional statement, no other incriminating material is collected showing the complicity of the petitioner in the present crime. Learned Assistant Public Prosecutor opposed to grant bail on the ground that investigation in the present crime is not completed and the petitioner herein has involved in one other crime. It is submitted by the learned counsel for the petitioner that the petitioner has permanent abode and there is no possibility of his fleeing away from the Jurisdiction of the Court. 5. In view of the aforesaid facts and circumstances of the case and considering the remand period of the petitioner, this Court is inclined to grant bail to the petitioner herein/A1, on the following conditions. i. The petitioner herein/A1 shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of 3 the learned Judicial Magistrate of First Class, Rampachodavaram. ii. On release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months. iii. The petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses. 6. Accordingly, the Criminal Petition is allowed. _____________________ T.
