01. 1. The bail petitions are clubbed together for disposal by the following common order. Page 2 of 3
2. Heard learned counsel for the petitioners and State. 3. Instant petitions are filed for release of the petitioners on bail in connection with 2(a) CC Case No.13 of 2024 (NDPS) pending in the file of learned Additional Sessions Judge-cum-Special Judge, Bhanjanagar corresponding to Bhanjanagar Excise P.R. No.93 of 2024-25 on the grounds stated. 4. Perused the PR as at Annexure-1 and rejection orders i.e. Annexure-3. 5. By the Court’s order as at Flags-A and B, the petitioner was granted the liberty to renew the prayer for bail after submission of final PR. 6. Mr. Panda, learned counsel for the petitioners submits that the final PR is filed in the month of January, 2025. The further submission is that the petitioners are in judicial custody from 25th October, 2024, hence, they should be released on bail with the closure of investigation. An objection is received from Mr. Jena, learned AGA for the State since the recovery relates to commercial quantity of Ganja. From the PR i.e. Annexure-1, the Court finds that 30 Kgs of Ganja was recovered from the petitioners. It is claimed that the petitioners have no other similar antecedent. Considering the submissions as above and since the investigation is concluded, the Court, recording such claim as to absence of criminal antecedent of similar nature and as trial is unlikely to be concluded in near future, is inclined to direct the petitioners to go on bail however with stringent conditions. 7. Accordingly, it is ordered. Page 3 of 3
8. In the result, the petitions stand allowed. Consequently, the petitioners are directed to be released on bail in connection with 2(a) CC Case No.13 of 2024 (NDPS) arising out of Bhanjanagar Excise P.R. No.93 of 2024-25 subject to them furnishing bail bonds of Rs.50,000/- (rupees fifty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, Bhanjanagar, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. The Court further directs that such release of the petitioners shall be upon verification and absence of similar antecedent against them. 9. The BLAPLs are disposed of. 10.
