Neutral Citation No. - 2025:AHC-LKO:36916-DB Court No. - 2 Case :- WRIT - C No. - 6243 of 2025 Petitioner :- Jantri Prasad Yadav Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue Lko. And 9 Others Counsel for Petitioner :- Shailendra Singh Chauhan,Hanumant Lal Yadav Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. The petitioner herein claims to have his house on Gata No. 503, which is recorded as 'Category 6-2'. Khatauni is annexed alongwith the writ petition. In respect of said land no person is recorded, as it is not a holding for agricultural purposes, rather, it is a land being used for non-agricultural purposes. It is alleged that the private opp. party herein is undertaking construction of a road on the said land. Reliance has been placed upon certain reports of revenue officials as well as a report of the Kshetriya Lekhpal, Mahmoodpur, dated 12.04.2025 wherein private opp. party has been warned not to undertake construction of the road, however, it is alleged that the police officials are facilitating construction of the said road. We cannot consider and determine the rights and interests of the petitioner in respect of such land over which his house exists. If the petitioner has any grievance against any of the district official(s), he can approach higher authorities, i.e. the District Magistrate or Superintendent of Police, Sultanpur, who may get the matter enquired as to how far the police officials or the revenue officials, if any, are illegally interfering in a civil dispute, but so far as the dispute of the petitioner viz.-a-viz. the private opp. party No. 10 is concerned, we cannot enter into such disputes under Article 226 of the Constitution of India, therefore, the petitioner will have to avail other remedies, available in law. If any such application is filed before the Superintendent of Police or District Magistrate, Sultanpur, as the case may be, enquiry may be got conducted to the extent aforesaid, i.e., the role of the police official(s) in the matter and no more, and if there is a cause, appropriate action will be taken against the official(s) concerned. We have not at all adjudicated the rights of the private parties. With the above observations/directions, this writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
