(ORAL) Peoner herein is the defendant before trial Court in Civil Suit tled ‘Davinder Mohan Vs. Pardeep Kumar Navea and another’, which was filed for seeking a decree of specific performance. 2. Peoner is aggrieved by the order dated 23.07.2018 (Annexure P-5) whereby his applicaon for direcng the plainff- respondent to appear before Central Forensic Science Laboratory to record his voice sample, was declined. 3. Learned counsel contends that in fact plainff had received the enre earnest money along with interest and the conversaon was recorded and therefore, it is necessary to compare the said recording with the sample voice recording of the plainff. 4. This Court does not find merit in the contenon. As has been rightly observed by the trial Court, in the Code of Civil Procedure, there is no provision for direcng the opposite party to give his voice sample for the purpose of idenficaon or to collect the evidence in this manner.
