ORAL ORDER
Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record.
2. FIR in Crime No.352/2024 of Rajarajeshwari Nagar Police Station is registered against accused Nos.1 and 2 for offences punishable under Section 140(1), 109, 352 r/w 3(5) of BNS, 2023.

It is the case of prosecution that on 06.12.2024 at about 7.30 p.m., when the complainant – Kushal Kumar was standing near R.R.Chicken Centre talking to Shivashankar, the accused came on a two wheeler and picked up quarrel with him stating that he is giving information to the police. They abused him in filthy language, assaulted him with hands and accused No.1 assaulted him with a bat. The victim however, escaped

from their clutches and went to his house and informed the matter to his mother. Thereafter, on the next day he went to the hospital and took treatment.
4. Petitioner is arraigned as accused No.2. He was arrested on 07.12.2024. He is in judicial custody. As per the wound certificate, the complainant/victim has sustained abrasions. Injuries are said to be simple in nature.
5. Learned High Court Government Pleader has contended that there are ten cases registered against the petitioner and therefore, if he is released on bail, he will once again commit similar offences.

Learned counsel for petitioner has contended that petitioner has been implicated in false cases and he has been released on bail in all the cases and in none of the cases he is convicted.
7. Specific overt act of assaulting the complainant with a bat is against accused No.1. Petitioner has been

interrogated and not required for further interrogation. Hence, by imposing conditions, he can be admitted to bail. Accordingly, the following:
ORDER (i) Petition is allowed. (ii) Petitioner/accused No.2 in Crime No.352/2024 of Rajarajeshwari Nagar Police Station, Bengaluru, is ordered to be released on bail, subject to following conditions:
1. He shall execute a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.

4. He shall mark his attendance before the jurisdictional Police Station on every Sunday between 10.00 a.m. and 11.00 a.m., for a period of four months.
5. He shall not indulge himself in committing any offence.
6. He shall appear before the trial Court regularly on all dates of hearing. Violation of any of the above condition shall result in cancellation of bail.
