Neutral Citation No. - 2025:AHC-LKO:37147-DB Court No. - 2 Case :- WRIT - C No. - 6255 of 2025 Petitioner :- Ram Ji Kasaudhan Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home And 3 Others Counsel for Petitioner :- Sachin Pandey Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. By means of this writ petition the petitioner has prayed for issuance of a writ, an order or direction in the nature of mandamus commanding the respondents to provide the proper facility of armed gunner/security guard to him, as provided earlier, at the cost of the State Government. He has also prayed for a direction in the nature of mandamus commanding the respondent no. 03 to take decision upon the pending representation before him. Petitioner was earlier provided a Gunner/security under the relevant Government Orders, however, he claims to be a witness in a trial arising out of F.I.R. No. 242 of 21 under Sections 342, 341, I.P.C., P.S. Dhanpatganj, District Sultanpur, against certain persons who, according to him, are hardened criminals having criminal history. If it is so, then the petitioner may move an application before the Committee, headed by the District Judge under the Witness Protection Scheme 2018, as approved by Hon'ble the Supreme Court in the case of Mahendra Chawla v. Union of India & ors., 2019 (14) SCC 615, whereupon the same shall be considered by the said committee, as per the aforesaid scheme, uninfluenced by the decision of the High Powered Committee under the relevant Government Order, as according to the Standing Counsel, the Committee constituted under the relevant Government Order has not found it necessary to extend the security granted earlier under the said Government Orders as there is no security threat to the petitioner, however, the protection under the Witness Protection Scheme is for the witnesses during pendency of trial, which is a separate matter and will have to be considered, as aforesaid. If any application is filed within one week, it shall be considered and appropriate decision shall be taken within the
next one month. With the above observations/directions, this writ petition is
disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
