Choudhury, learned counsel for the petitioner and Mr. K. K. Porasor, learned Additional Public Prosecutor, Assam. This is the 2nd bail application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Ohidul Islam @ Ahidul Islam @ Rahul, who has prayed for release on bail in connection Page No.# 2/2 with Bongaigaon P.S. Case No. 121/2025. There was an allegation that in a unisex beauty parlour the owner was running the trade of prostitution. When Police raided the beauty parlour, the petitioner was found in a nude state. The earlier bail application of the petitioner was rejected by this court on 12.06.2025. According to Mr. Choudhury, the petitioner has already spent 39 days in judicial custody. After considering the submissions made by the learned counsel for both sides, this court has decided to hold that the period of detention already undergone by the petitioner deserves to be taken as a ground for releasing him on bail. Hence, the bail application of the petitioner is allowed. Accordingly, The petitioner Ohidul Islam @ Ahidul Islam @ Rahul, who is in custody in connection with Bongaigaon P.S. Case No. 121/2025, is allowed to go on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Bongaigaon.
