ORDER 19.11.2025 Petitioners claim to be owners in possession of a three-storeyed residential house, along with land underneath measuring 2529 sq.ft, situate at Jawahar Nagar, Srinagar, by virtue of a sale deed duly registered before Sub-Registrar, Srinagar on 07.02.2000. The case set out is that when petitioners intending to lease out a portion of their residential house approached the concerned revenue officer for the issuance of revenue documents, necessary for registration of lease deed, they came to know that revenue record had not been updated and their names were not reflected in the ownership column. Consequently, they filed an application before Tehsildar concerned on 08.08.2025 for attestation of mutation, in the light of registered sale deed with respect to their residential house. According to the petitioners, they were under a bona fide belief, after the registration of sale deed, that revenue authorities would have acted upon and attested mutation in their names, but they have failed to perform their statutory obligation and Tehsildar concerned has failed to decide the application preferred by them for attestation of mutation, even after the expiry of statutory period of 30 days under Section 5 of the Jammu & Kashmir Public Service Guarantee Act, 2011. Having regard to the limited nature of controversy, the present petition at the threshold is admitted to hearing and is disposed of with a direction to the respondents to decide the application preferred by the petitioners for attestation of mutation, in accordance with law, within a period of two weeks from the date copy of this order, along with copy of petition and annexures are made available to them.
