HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 6095 of 2025 Court No. - 12 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that the daughter of the informant was married in the year 2019 with the applicant. Out of the wedlock, one child was born. It is alleged that on 28.1.2025, the in-laws of the deceased informed the complainant that she had died. When the complainant went to the house of the in-laws, she found the body of the deceased bearing several injury marks. Learned counsel for the applicant submits that in the post-mortem report, the cause of death is asphyxia as a result of ante-mortem hanging. Except the ligature mark, there is no other injury found on the body of the deceased. He submits that the prosecution witnesses i.e., PW-1 and PW-2 have not supported the prosecution case during trial and therefore, they have been declared hostile. Thus, there appears to be no chance of tampering the prosecution evidence. It is further submitted that the applicant has no criminal history and he is languishing in jail since 31.1.2025. There is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Versus Counsel for Applicant(s) : Ashok Kumar Srivastava, Avinash Srivastava Counsel for Opposite Party(s) : G.A. Rohit Patel .....Applicant(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. .....Opposite Party(s)

Accordingly, the bail application is allowed.
