Neutral Citation No. - 2025:AHC-LKO:37449 Court No. - 14 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 801 of 2025 Applicant :- Suhel Opposite Party :- State Of U.P. Thru. Secy. Home Lko. Counsel for Applicant :- Rizwanul Haque Ansari,Santi Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant, learned A.G.A. for the State, and perused the material available on record. The present application has been filed seeking anticipatory bail in Case Crime No. 278 of 2025, under Sections 3, 5, and 8 of the Uttar Pradesh Prevention of Cow Slaughter Act, Police Station Gola, District Kheri. As per the prosecution case, on 28.04.2025, the police received information from a secret informer that near the village Rampur Gokul and Bijhauli Pul, the accused persons had slaughtered 4–5 cow progeny. The remains of the animals were found at the spot, while the accused persons had fled.
Learned counsel for the applicant submits that the alleged offence is triable by a Magistrate. The applicant was not arrested from the spot, and his name surfaced only on the basis of a confessional statement made by a co-accused. He has been falsely implicated. The applicant has also explained the criminal history involving five cases, as mentioned in paragraph 17 of the bail application. Learned A.G.A. has opposed the prayer for anticipatory bail and submits that the applicant has a criminal history of five cases, out of which three are related to cow slaughter. He is a habitual offender, and no ground for anticipatory bail is made out. I have considered the rival submissions and perused the record. On due consideration of the submissions advanced by the learned counsel for the parties and the criminal history of the applicant, particularly involving similar
offences, this Court is not inclined to enlarge the applicant on anticipatory bail. Accordingly, the anticipatory bail application is rejected. However, if a regular bail application is filed by the applicant, the same shall be considered and decided expeditiously in accordance with law.
