Learned Standing counsel for the State has instructions from the S.D.M., Alapur, District Ambedkar Nagar, so does Sri Suyash Dwivedi appearing for opposite party no. 4 and newly impleaded opposite party No. 13 that construction of road was taking place on Gata No. 1274 and 1275, but in this process some portion of Gata No. 1273, of which the petitioners claim to be the Bhumidhar, was getting affected, therefore, the construction has been stopped. In view of the above, this petition is disposed of with the observation/direction that the opposite party should first of all get the aforesaid Gatas demarcated in presence of the petitioners, so as to ensure that Bhumidhari land of the petitioner is not utilized or encroached in any manner for construction of the road or its widening, unless of course it is purchased or it is compulsorily acquired.
