25 Regular IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CRM(M)/454/2024 MOHAMMAD SHABAN MALLA ….. Petitioner (s) Through: None. V/s KASHMIR KING CENTRAL MARKET ABI GUZAR .. Respondent(s) Through: None. Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 08.12.2025 Nobody had been appeared on behalf of the petitioner on last date of hearing. Today also, same is the position. Even steps for effecting service upon the respondent have not been taken. The petitioner through the medium of present petition, has challenged complaint filed by the respondent against him in which the learned Judicial Magistrate, 1st Class (Special Mobile Magistrate PT &E), Srinagar has taken cognizance and issued process against the petitioner and co-accused. I have gone through the impugned order dated 03.02.2023 passed by the learned trial Magistrate and I have also gone through the averments made in the impugned complaint. I do not find any ground to interfere with the impugned order passed by the learned trial Magistrate as the allegations made in the impugned complaint clearly disclose cognizable offences against the petitioner. The petition lacks merit and is accordingly dismissed. (Sanjay Dhar) Judge SRINAGAR 08.12.2025 Aasif
