[2025:RJ-JP:15447] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 4920/2025 Ashish @ Ashu S/o Anjani Kirodiwal, Aged About 29 Years, R/o 5A, Krashnapuri Sodala, Police Station Sodala, Jaipur (Rajasthan) (At Present Confined In District Jail, Sawai Madhopur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Girish Khandelwal For Respondent(s) : Mr. Amit Poonia, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 07/04/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 33/2025 registered at Police Station Mantown, District Sawaimadhopur for the offence under Sections 318(4), 319(2) 316(2), 336(3), 338, 340(2) of BNS and Section 66-D of IT Act and Section 13 of the Rajasthan Public Gambling Ordinance, 1949. Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioner are triable by Magistrate. The accused-petitioner is in custody since 29.03.2025 and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. [2025:RJ-JP:15447] (2 of 2) [CRLMB-4920/2025] Per contra, learned Public Prosecutor opposes the grant of bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioner are triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ashish @ Ashu S/o Anjani Kirodiwal, in connection with FIR No. 33/2025 registered at Police Station Mantown, District Sawaimadhopur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
