JUSTICE ANOOP KUMAR DHAND Order 22/04/2025
1. The instant writ petition has been filed by the petitioner with the following prayer:-
“The respondent University may be directed to permit the humble petitioner to participate in the B.Sc. B.Ed. Third year Examination 2025 and accordingly to complete his further course by way of applying the judgment of the Hon’ble Supreme Court in regard to statutory limitation not to come in the way during the COVID-19 and accordingly all consequential benefits may be directed to be extended to the humble petitioner in the interest of justice. [2025:RJ-JP:16912] (2 of 3) [CW-5887/2025] Any other appropriate order or direction as deemed fit may be passed in favour of the humble petitioner in the interest of justice.”
2. By way of filing this writ petition, the petitioner is seeking direction against the respondent-University to allow him to participate in the B.Sc. B.Ed third year examination, 2025 and allow him to complete further studies in the light of the order passed by Hon’ble Apex Court In Re:Cognizance For Extension of Limitation (in Suo Motu Writ Petition(c) No.3/2020). 3. As per the contents of the writ petition, the petitioner took admission in B.Sc B.Ed in the year 2019 and he participated in the second year examination in the year 2021 wherein his result was declared on 11.03.2022. Even after expiry of more than three years, the petitioner did not bother to appear in the third year examination and the explanation given by the petitioner was that on account of ill-health of his father, he could not appear in the subsequent years for taking third year examination. Now the petitioner wants the benefit of the order passed by Hon’ble Apex Court in Re-cognizance For Extension of Limitation. The order passed by the Hon’ble Apex Court is not applicable in the facts and circumstances of the present case.
The order was passed by the Hon’ble Apex Court during the COVID 19 Pandemic and it was over by the end of the year 2021 and there was no reason available to the petitioner to take shelter of COVID-19 in the subsequent years after i.e. 2022-2025. The petitioner was sleeping over the matter since last more than three years and has now woke up in the year 2025. The relief sought in this petition cannot be granted by this Court in the writ jurisdiction contained under Article 226 of the Constitution of India. [2025:RJ-JP:16912] (3 of 3) [CW-5887/2025]
4. This Court finds no merit and substance in this petition and the same is hereby dismissed. 5. Stay application and all pending application(s), if any, also stand dismissed. (ANOOP KUMAR DHAND),J Ashu/33
