State Public Distribution System Control Orders, 2011 and pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondent no.3 to allot the commodities to the petitioner’s F.P.Shop No.34, Amadalagunta Village, Kondumuru Mandal, Kurnool District, Andhra Pradesh by allowing the petitioner to distribute the same to the cardholders pending disposal of the above writ petition and pass Counsel for the Petitioner: 1. GP FOR CIVIL SUPPLIES 3 The Court made the following Order: The present Writ Petition was filed under Article 226 of the Constitution of India seeking the following relief:- “…. to issue a writ, order or direction more particularly one in the nature of a writ of Mandamus declaring the action of the respondents 2 to 6 in not allotting the commodities/stocks to the petitioner’s F.P.Shop No.34 Kodumuru Village and Mandal, Kurnool District, Andhra Pradesh inspite of petitioner’s authorization is subsisting as illegal, arbitrary and contrary to the A. P. State Public Distribution System Control Orders, 2011 and to pass such other order or orders….” 2. When the writ petition came up for admission on 22.07.2020, this Court was pleased to pass the following interim order in I.A.No.1 of 2020: Having heard the learned counsel for the petitioner and having regard to the submissions made by the learned counsel for the petitioner, there shall be interim direction as prayed for, if the authorization of the petitioner is subsisting as on today. However, pendency of the Writ Petition and the subsistence of the interim order, will not come in the way of the respondents from proceeding in according with law. 3. Today, when the writ petition came up for hearing, the learned Assistant Government Pleader furnished a copy of the instructions of the Tahsildar, Kodumur Mandal, i.e., the 5th respondent herein vide Rc.B.50/2020, dated 10.09.2025, wherein, it is stated that, pending the writ petition, the District Collector (CS), Kurnool, vide his proceedings bearing Progs.No.Rc.CS3/92/2020, dated 17.08.2020, has restored the petitioner’s authorization and allotted the essential commodities for distribution and till 4 date the petitioner is running the fair price shop and distributing the essential commodities every month without any complaints. 4. Recording the same, the Writ Petition is closed. There shall be no order as to costs.
