In the suit instituted by plaintiffs-respondent no. 4 and 5, an application under Order VII Rule 11 was moved which was rejected by trial court against which a misc. civil appeal was preferred which has also been rejected. I have perused the material on record and find that there is no infirmity in the order impugned. Writ petition is misconceived and stands dismissed. The defendant has a remedy of raising the said fact at the time when the issues are decided in the said suit.
