Neutral Citation No. - 2025:AHC-LKO:37056-DB Court No. - 2 Case :- WRIT - C No. - 6238 of 2025 Petitioner :- Murali Dhar Respondent :- State Of U.P. Thru. Collector Ayodhya And 6 Others Counsel for Petitioner :- Ram Nath Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Sri Ram Baran Mishra, Advocate, has put in appearance by filing his vakalatnama on behalf of opp. party No. 7, which is taken on record. The petitioner herein claims to have his house on Gata No. 515, which is 'Abadi Land'. A civil suit is said to have been filed by private opp. party in respect of the said Gata, of which he is the Bhumidhar. It is alleged that the police officials are conniving with the private opp. party to interfere with possession of the petitioner. Sri Ram Baran Mishra, Advocate, appearing for the private opp. party, says that his client is co-sharer in Gata No. 159 and the petitioner is undertaking construction on his land. Considering the aforesaid, we are of the opinion that so far as the private dispute between the private parties are concerned, the parties may avail the remedies as prescribed in law, as such disputes pertaining to land and property cannot be decided under Article 226 of the Constitution of India. So far as the grievance against the police officials of P.S. Inayat Nagar of District Ayodhya is concerned, the issue may involve a factual inquiry, therefore, if the petitioner has a cause, he can approach the Senior Superintendent of Police, Ayodhya, raising his grievance, specifically against the concerned police officials, who may get the matter inquired by responsible officer to ascertain the factual position and take such action as may be required in law. With the above observations/directions, this writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
