The instant application under section 483 Cr.P.C./529 of the B.N.S.S.,2023 has been filed with the prayer to direct the trial court i.e. the learned Additional Principal Judge, Family Court, Court No. 1 Gonda to decide the case of petitioner bearing Criminal Miscellaneous Case No. 1174/2023 (Rukhsar to Siddiqui Vs. Noman) filed under section 125 Cr.P.C. for maintenance allowance, pertaining Police Station Khargupur, District- Gonda pending before him since 26.10.2023, expeditiously or within a reasonable period of time as directed by this Hon'ble Court, in the interest of justice. Learned counsel appearing for the applicant submits that the matter pertains to the year 2023 and even after passing of about 2 years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the trial court is directed to consider and decide the Criminal Miscellaneous Case No. 1174/2023, with expedition, in accordance with law considering the instructions and guidelines issued by this court; time to time. With the aforesaid observation, the instant application stands disposed of.
