Neutral Citation No. - 2025:AHC-LKO:37150 Court No. - 18 Case :- WRIT - A No. - 6990 of 2025 Petitioner :- Rameshwar Saran Respondent :- Uoi Thru. Secy. Ministry Of Home Affairs New Delhi And 5 Others Counsel for Petitioner :- Ajeet Kumar Counsel for Respondent :- A.S.G.I. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner, Shri S.B. Pandey, learned Deputy Solicitor General of India assisted by Shri Varun Pandey, learned counsel for opposite parties.
2. Petition has been filed challenging the revised result dated 05.09.2024 and order dated 10.05.2025. Further prayer for direction to opposite parties not to interfere in peaceful functioning of petitioner at the place of posting without conducting full-fledged inquiry in the matter has also been sought.
3. At the very outset, learned counsel for opposite parties raised a preliminary objection regarding maintainability of this petition on the ground that impugned order dated 10.05.2025 in-fact is only a show cause notice, which has been issued to petitioner, to which the petitioner has already submitted a reply and final decision is yet awaited.
4. Learned counsel for petitioner admits that letter dated 10.05.2025 in-fact is only a show cause notice to which he has already submitted reply but submits that full-fledged inquiry in such a dispute was not warranted since it only pertains to a minor mistake.
5. Upon consideration of submissions advanced by learned
counsel for parties, it is evident that the petitioner is challenging a show cause notice dated 10.05.2025 to which he has already submitted reply and final decision is yet awaited. It is not the case of the petitioner that show cause notice has been issued without jurisdiction.
6. In view thereof, this Court does not find any good ground to interfere in the impugned show cause notice. However, liberty is granted to the concerned authority to pass final orders in accordance with law on reply submitted by the petitioner to the show cause notice.
7. With the aforesaid observations/directions, the petition stands
disposed of.
