Borthakur, learned Additional Public Prosecutor for the State and Mrs. R. Rongmei, learned counsel for the respondent No.2/informant. 2. This application filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, the accused petitioner namely, Mon Bahadur Pradhan, has prayed for bail in connection with Baithalangso P.S. Case No. 08/2025 under Section 64/62 of BNS, 2023 r/w Section 8 of POCSO Act, 2012. 3. The gist of allegation and the FIR dated 26.05.2025, that the accused try to committing sexual assault upon the informant daughter. It is also stated in the FIR that subsequently he came for forgiveness whereupon the informant came to know about the incident. 4. I have perused the statement of the victim girl recorded before the Magistrate which is available in the scanned TCR. 5. The investigation is completed and the case is pending before trial though prosecution evidence has not yet been started. 6. The learned counsel for the informant submits that she has no objection to grant bail at this stage. 7. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Baithalangso P.S. Case No. 08/2025 under Section 299 of BNS, 2023 r/w Section 64/62 of BNS, 2023 r/w Section 8 of POCSO Act, 2012, on furnishing bail bond of Rs.30,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court Special Judge, POCSO, West Karbi Anglong. 8. The direction for bail is further subject to the conditions: (a) That the accused shall be available for trial; Page No.# 3/3 (b) That the accused persons shall not hamper or tamper with evidence; and (c) That the accused shall not in any manner intimidate or harass and harm to the victim and family. 9. Violation or breach of any condition(s) shall entail cancellation of bail. 10. With the above observations, this bail petition stands allowed and disposed of accordingly. 11.
