Gogoi, learned counsel appearing for the respondents/ Finance Department as well as Health Department, Govt. of Assam submits that necessary funds for release of the monthly honorarium to the petitioners have already been sanctioned and the payments have also been released. Therefore, submits Mr. Gogoi nothing survives in this contempt case. Responding to the above, Mr. Khan, learned counsel for the petitioners submits that
Page No.# 3/3 while many of the petitioners have received the amount, some are yet to receive the same. The petitioner’s counsel, however, could not indicate as to which of the petitioners have not received the amount or the reason for not doing so. Be that as it may, it appears that the respondents have already done the needful for compliance of the Court’s order. Situated thus, this Court is of the opinion that keeping this contempt case pending would not serve any practical purpose.
As such, by granting liberty to those petitioners, who continue to remain aggrieved in the matter, to avail appropriate legal remedy, this contempt case stands closed. It is also made clear that those petitioners, if any, who have not received the arrear honorarium till date despite the Court’s order and inspite of the same having been sanctioned by the Govt. shall also be at liberty to approach the concerned authority seeking release of the amount in a time bound manner, if so advised.
