None appears on behalf of the parties. This is an application under section 482 of the Code of Criminal Procedure for quashing of proceeding being G.R. Case No. 824 of 2012 pending before the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur arising out of Contai Police Station Case No. 280 of 2012 dated July 28, 2012 under sections 147/149/448/323/354/376(2)(g)/ 380/427/506 of the Indian Penal Code. The matter was first taken up on February 13, 2015, when direction was given to the petitioners to serve notice and copy of the application upon the opposite party no. 2 by Speed Post with acknowledgement due and upon the opposite party/State through the learned Public Prosecutor, High Court at Calcutta and an interim order of stay was granted for a period of ten weeks or until further order, whichever is earlier. The said interim order was extended for a further period of ten weeks on May 5, 2015 followed by an extension till December, 2015 on October 13, 2015. Thereafter the matter appeared on June 16, 2022, when accommodation was sought for on behalf of the petitioners and Mr. 2 Sandip Chakraborty, learned advocate was requested to appear in this case on behalf of the opposite party no.1/State of West Bengal On June 30, 2022, both the parties appeared and the State was directed to submit a status report regarding the proceedings before the learned trial court, which was duly complied with and the said report was submitted before the Court on July 13, 2022, which revealed that the date was fixed for ER of W/A in respect of three accused. On August 17, 2022, the matter appeared and on behalf of the petitioners , an accommodation was sought for, which was allowed and lastly the matter appeared on August 26, 2022, when further accommodation was sought for on behalf of the petitioners and the same was granted. Since thereafter, the matter never appeared in the list and was running in the Warning List since February 20, 2025. Today also, none appears on behalf of the parties. Considering the long pendency of the matter, and in absence of any prayer for extension of interim order, this Court is of the view that there is no reason to keep the matter pending in the list. Accordingly, C.R.R. 477 of 2015 and I.A. No. C.R.A.N. 3 of 2015 (Old C.R.A.N. 4572 of 2015) are dismissed for default. Let a copy of this order be sent down to the court below by the department forthwith for information and necessary action. (Chaitali Chatterjee (Das), J.)
