Mr. Akhil Kumar Sah, learned counsel for the applicant. 2. Mr. V.S. Pal, learned AGA for the State. 3. Present applicant–Manjeet Singh S/o Shri Santokha Singh is seeking regular bail in relation to first information report dated 28.05.2025 bearing FIR No. 0071 of 2025, Police Station Kotwali Pitthoragarh, District Pitthoragarh, lodged for the offences punishable under Section 8/21 read with Section 60 of the NDPS Act, wherein two persons, namely, Nishant Bora and Sandeep Joshi were implicated. During investigation, the applicant was arrested and made an accused for the offence punishable under Section 29 of the NDPS Act. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated and there is no recovery of any contraband from the present applicant and whatever be the recovery has been shown is from the possession of other two co-accused, namely, Nishant Bora and Sandeep Joshi, who have already been granted bail by this Court on 16.06.2025 and 23.06.2025. 5. It is also contended by learned counsel for the applicant that there is no substantial compliance of Section 50 of the NDPS Act and, furthermore, the applicant have no previous criminal history and taking into consideration that the other two co- accused, who are named in the FIR, have 2025:UHC:9550 already been enlarged on bail, the applicant be also released on bail. 6. On the other side, Mr. V.S. Pal, learned AGA, have not disputed this fact that the other two co-accused, namely, Nishant Bora and Sandeep Joshi, have already been enlarged on bail and so far as the present applicant is concerned, he is only an accused for the offence punishable under Section 29 of the NDPS Act and there is no recovery from the present applicant, and, furthermore, the applicant has no previous criminal history. 7. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration that the other two co-accused have been granted bail and the applicant has no previous criminal history, this Court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicant, namely, Manjeet Singh, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
