Neutral Citation No. - 2025:AHC-LKO:38127-DB Court No. - 2 Case :- WRIT - C No. - 6161 of 2025 Petitioner :- Yogendra Singh And Another Respondent :- State Of U.P. Thru. Its Prin. Secy. Home Lko. And 3 Others Counsel for Petitioner :- Indu Prakash Singh Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard. 2. The petitioners had applied for issuance of character certificate under the 'General Clause' and not for contract purposes. The Superintendent of Police, District-Sitapur rejected the application on the ground of pendency of a criminal case. The petitioners' Counsel says that there was one criminal case against the petitioners in which final report has been submitted, though, he is not aware as to whether it has been accepted or not. The Standing Counsel says that if the character certificate is required for the purposes of business or contract then it should have been mentioned on the portal as in such situations the certificate is issued by the District Magistrate after getting a police report whereas in other situations i.e. when a person applies under the 'General Clause', it is the Superintendent of Police himself who decides the application for issuance of character certificate as has been done in this case. Let the petitioners submit a fresh application for issuance of character certificate to the District Magistrate, District- Sitapur for contractual/business purposes and thereafter, the same shall be considered and appropriate orders be passed keeping in mind our recent judgment dated 28.05.2025 in Writ C No.718 of 2025 with expedition say within a period of three weeks of submission of aforesaid application. 3. With the aforesaid observations/directions, the writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
