Appellant was convicted u/s 354 IPC & u/s 9/10 of the Protection of Children from Sexual Offences Act and sentenced five years’ simple imprisonment with fine of Rs.5,000/- with default stipulation one month’s additional simple imprisonment, vide judgment & order dated 03.08.2023 passed by learned Special Judge (POCSO)/ Additional Sessions Judge, Dehradun in Special Sessions Trial No.59 of 2020 State of Uttarakhand Vs. Shakil @ Sonu. 4. Vide order dated 10.10.2025, learned State Counsel was directed to bring on record the custody certificate of appellant in view of the statement made by learned legal-aid counsel that appellant had already served out the sentence imposed upon him. 5. Today, learned State Counsel passed on to this Court written instruction dated 12.10.2025, which is taken on record. 6. According to the said instruction, appellant has already served out the sentence imposed upon him and he has been released on 09.04.2025 from jail on completion of sentence imposed upon him. 2025:UHC:10911 7. In view of the said instruction, the present criminal jail appeal has rendered infructuous. 8. Accordingly, the present criminal jail appeal is dismissed as infructuous.
