The Writ Petition bearing Writ B No.1824 of 1988 (Dhani Ram and Others Vs. D.D.C. and Others) filed by the father of the petitioner challenging the order of the D.D.C. under Section 48 of the Uttar Pradesh Consolidation of Holding Act, 1953 was dismissed for want of prosecution on 23.01.2025. An application for restoration of the same has been filed, on which notices have been issued on 20.06.2025. In the interregnum, the private opposite parties, as alleged, are proceeding to cut the trees etc. This writ petition is not maintainable. The petitioner should pursue the application for restoration filed in the earlier writ petition before the Single Judge or seek other remedies as may be permissible in law.
