Neutral Citation No. - 2025:AHC-LKO:37233 Court No. - 7 Case :- WRIT - C No. - 6191 of 2025 Petitioner :- Mohd. Abdullah Azam Khan Respondent :- State Of U.P. Thru. Collector Rampur And 3 Others Counsel for Petitioner :- Aftab Ahmad Counsel for Respondent :- C.S.C. Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent and perused the record.
2. The present petition has been filed by the petitioner challenging an order dated 12.06.2025, whereby the recovery citation has been issued by the respondent no. 4.
3. It is argued by the counsel for the petitioner that an order came to be passed against the petitioner assessing the deficiency of stamp duty and levying penalty thereupon vide
order dated 03.04.2025. Challenging the said order, the petitioner had approached the Board of Revenue by fling a revision under Section 56(1) of the Stamp Act, however, despite filing the stay application before the revisional Court, no order has been passed by the revisional authority so far. He thus argues that on the one hand, no order has been passed on the stay application preferred by the petitioner and on the other hand, the recovery is being pressed in pursuance to the R.C. dated 12.06.2025.
4. Considering the said submission, the present petition is
disposed of directing the respondent no. 2 to pass orders on the stay application preferred by the petitioner in the pending revision filed under Section 56(1) of the Stamp Act within a period of three weeks from today. Till the passing of the order as directed above, no action for recovery shall take place against the petitioner.
5. Learned Standing Counsel is directed to communicate this
order to the Board of Revenue for its compliance within the time framed.
